  1. Thank you for this information! I will pass it along to her. She's never spent the other part so she'd have almost 3 years worth. I'm sure she could use it since she's raising her twin grandsons.
  2. Wow!! Thats ridiculous! It should never take that long and it's a shame you had to wait for what was owed to you. Smh! My wife's grand father passed away in Nov 2009. His wife has been receiving VA payment ever since in Full payment of what he was getting before he passed. She has contacted them several times telling them of their mistake but they've never fixed it. She's been in contact with the local VFW also and he keeps telling her to "just spend it". Her husband was a smart Marine and taught her well how the VA works. She puts the overpayment in a separate savings account every month cause she knows eventually VA is going to want it back. The VFW tells her that she should just spend it and if and when the VA wants it back, they'll take care of it. I'm glad she is smart enough to know to never listen to VSOs over common sense.
  3. I feel your frustration and hope your claim goes in your favor so you don't have to worry about a appeal. But I agree with you. I'd pull the plug on them too. Good luck to you!
  4. Thank you free spirit!! I was told on Jan 22 that everything was fine and the form was in the computer so I would be getting paid as normal. But, on March 1st I checked my acct and 2/3 of my check was missing. I called them and was told it would take 3 months to fix. Its been (almost) 9 months now and nothing is fixed. My VSO said VA wanted me to resubmit the form so I did. In April I got a letter with a C&P exam scheduled. The VSO said he didnt understand why they were making do a C&P exam but just to do whatever they asked me to do. I went to the exam in early April and moved to prep for decision on May 18. Each person I've talked to at my RO says, anyone can clearly see it was VAs mistake and didnt understand how it happened and why they havent got it fixed yet. I did a IRIS and after 3 weeks I got a email saying they couldn't give me any information other than, normal claims are taking approximately 9 months to complete but I should call the American Legion for updates and provided me a number. I called the number only to get chewed out by some grouchy man saying, you were in the military!! You know how chain of command works!! Don't ever call this office again if you want a update call your local American Legion office. So far nobody has been able to help me with this issue and only say they've never seen anything like this before. So basically I've been waiting since March 1st. Im glad you got your claim fixed and completed!

  6. Supposedly I am close according to American Legion but who knows they have been telling me that since the end of May. I definitely don't want to affect my claim I have now. The VA took my IU because they say I didnt turn in a form before Feb 1st. I turned it in on Jan 22 which VAs computer system shows but they took it anyway and claim it was a computer error. I lost 2/3 of the check I had been getting for 6 years. It's been really hard on me financially. I have 1 boy in college, 2 teenage boys in high school and a 10 yr old daughter. This has been a fight from the beginning and my VSO doesn't seem to have any knowledge on how to fix it. He says he's never seen this happen before and he's learning from the experience.

  9. One more thing I forgot to add...Several years ago I had trouble walking because of the constant pain in my left foot. I later found out by my VA Dr that I had sever nerve damage due to being in the military. They wanted to operate and do tarsal tunnel surgery on it saying it would take the pain away and it would be better. Like a fool, I believed it and had the surgery. I've barley been able to walk since. I put in a claim for it with all the right evidence. Months later I got my bbe in the mail. I was denied! The explanation was, there wasnt any evidence showing I had any injuries in my "right" foot. My Right foot!! My claim and all evidence clearly stated my "left" foot. I went to my VSO the next day and was told that I should have never put a claim in for that. I asked if I should appeal it and he said, No not unless you want to lose your IU. He said the VA would take away my IU if I appeal it. I never appealed it nor put in another claim for it. I have several claims I never put in for because I was told the same thing by him each time, you will lose your IU. This was several years ago and much before my hadit days so I basically didn't know any better and thought he knew his job and besides that...he was there to help me. I really just didnt know any better. Thank you to all hadit people for the time you put into this site. You have taught me butt loads of information and I now feel more confident in filling a claim. Thank you to everyone on hadit for you comments and your personal experiences. Its comforting knowing I'm not fighting this battle alone.
  10. I believe there are a handful of VSO's who do work on claims because they want to help veterans and to them I say thank you!! But the ones like I have, dont care if you have 10% or 100% and give you so much misinformation. They have told me lies just to get me off the phone and never seem to know how to answer a question correctly and timely. I usually get the, uh uhh uhhh....ill have to find that out for you. But then never call me back with a answer and act as if they don't know what I'm talking about next time I talk to them. So to them I say, thanks for Nothing!!
  11. There are a lot of older elderly vets in this area that should have a higher percentage but don't because they dont have access to the internet and wouldn't know how to use it if they did. They do things the only way they know how and thats through organizations. If workers really cared they would help more.
  12. Mine (American Legion) works for the State and have a office in the State building. One of the employees lives up the street from me. They get paid very well for their job but the thing is, they dont really do anything. Like everyone agrees with, evidence wins the claim. They have no passion (in my local office. Dont know about others) for helping anyone. It's just a job for them that pays the bills.
  13. I couldn't again more Phillip Rogers. I've contacted the American Legion several times in the past 9 months and I've only talked to him maybe 3 times (if that). I've never got a update on anything thats going on. And the guy knows my problem is a VA mistake and he told me in the beginning it would take 3 months to fix. I wasn't sure how I was going to pay bills and put food on the table for those 3 months. Now, here it is 9 months later and nothing has changed. I'll probably lose everything I have because of this but I don't think he gives a damn!!!
  14. Penny your claim is similar to mine. Mine has a start date of Jan 22 2013. It is also a Administration Review and I have been in Prep for Decision since May 18. And last, mine also says, At this time your RO can not provide an estimated completion date. I'm not sure what the difference is between a Administration Review and a regular claim.
  15. Hopefully they'll get yours completed before that time. Mine doesn't have one. It says, at this time your RO doesn't have a estimated competition date. I'm not sure if thats a good or bad thing. Good luck with your claim and thank you for your service!
  16. It means your claim has all evidence needed and is now just waiting to be rated. Each claim is different in terms of how long it takes in the rating phase. Mine has been in preparation for decision since May 18 of this year. I've seen some peoples claim get rated pretty quickly though. Does your claim have a estimated competition date?
  17. You're right. That was the word I was wanting to use but wasn't exactly sure what it was. He always said 99 out of 100 people will get it if they put in a claim for it. Thanks for the correction!
  18. Fighting the VA for compensation that you earned and is owed to you is a long emotional battle. Don't ever give up the fight! I was told by my wife's grandfather, who was a retired Marine and helped many vets get on board with veterans affairs, to always put in a claim for hearing loss. More than likely you will always get 10% for it. I'm not sure if thats true or not but most vets I personally know have a % for hearing loss. Just a thought...
  19. Mine hasn't changed since May 18. It shows in "what we never received" part, about 7 things they say they never got but in the "evidence" part it shows the things there. Some of them 2 or 3 times. I wouldn't let ebenefits discourage you or incourage for that matter.
  20. I think Ebennies will let you choose what info you want to show before you print it. I have a question... If you are 100%, how do you know if its IU or TDIU? Do you get the same benefits for both?
