Question

:D :D :angry::angry: :o :D :rolleyes: :D

Just read on VA Watchdog where many "veterans" are lying about stressors in order to claim benefits. I was a Dog Handler in Nam "70" - "71", 101st 47th IPSD. Tried for several years to get SR benefits for injuries and PTSD received while overseas but always got the same old story....WE NEED PROOF OF STRESSORS. Now after almost 40 years and many sleepless nights and nightmares, failed relationships, going from job to job, etc., I'm finally coming to terms with my past "life". I'm close to receiving benefits for Dabetes II and anxiety disorder, the latter not PTSD because I don't believe the "examiner" did his homework. My question is, am I going to have trouble with PTSD claim because only one out of three of my stressors was documented. The other 2 are true but were buried due to the nature. Can we say "cover-up" ? Been waiting for 2 months now for decision. I know I will have to file a NOD but am not letting the VA screw me again.

I am not jumping on an Elder. Was just voicing my opinion on what I thought to be an unfair statement on Vets being suspicious for filing for PTSD. I will still stand by that opinion. If you think I was jumping on an Elder I can't do anything different. The last time I looked, this is still America and I am still a VietNam Veteran that fought for the right to give people the right to stand up for what they think is right and what is wrong not matter who that person may be. If that cost me the right to post in this forum so be it. But its still a right for every single Veteran in this forum to be able to voice their opinion right or wrong without having the fear of being ridiculed or banned. I think the last time I checked, that was called Censorship and thats not suppose to happen in this country.

Okay.......alright already...........you're a good person, you didn't mean to demean (or be mean) to anyone, you were standing up for yourself (for a perceived wrong that really wasn't "aimed" at you, BTW)............we are glad you are here and taking part in our discourse...........and want you to stick around.........and we can certainly use some good minds to help us along............(maybe you can help me find my mine....seems I've misplaced it due to stress, etc.)...........now, let's all participate in a group grope and a hearty HIGH-FIVE.

sheeeeeeeesh! :)

My people, some of them, have run away to the hills, and have no blankets, no food; no one knows where they are-perhaps freezing to death.

I want to have time to look for my children and see how many of them I can find.

Maybe I shall find them among the dead.

Hear me, my chiefs! I am tired; my heart is sick and sad.

From where the sun now stands, I will fight no more forever."

We have been here a long time and we have been through this many times before. Lets just keep it real. Sometimes it is difficult to cope with th e folks on this board but in the long run we are all here for a common purpose. That purpose is to give and receive help for our VA situations.

Hang in there as you have my support. I feel for the RVN Vets because they really got the shaft and continue to get shafted each and every day.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

:) Good Morning Everyone;

I must apologize for taking so long to get back on here before things got out of hand. Let me try a clear this up. First I'm sorry for not putting into post where on Watchdog I actually saw the article, when I first read it I got scared because I have filed claims for PTSD for 10 or more years but never had the courage to write about my stressors. Like many of us Viet Nam Veterans we have tried to forget the past and what we endured over there as well as what we have gone through since returning home. With the help of my PTSD counslers and PTSD group sessions I am slowly trying to come to terms with my past.....here and overseas. My life before going to Nam was hope filled. I was supposed to come home to be a State Police Officer in Michigan. Had most of my life planned with marriage, family, and the GOOD life. When I returned home all that was gone, replaced by things I seen and did while in Nam. My first try at suicide was 1 month after I came back, from there it was all downhill with no way to stop. Never could hold down a job, failed marriage, estranged from my entire family, drugs and alcohol, constant failed relationships, etc. But enough of that because we all know where that leads.

Now to the point of all this. I wrote 3 stressor accounts for the VA. It took me almost 3 months to complete them. After submitting them along with my 9th claim for PTSD I only let one other person read them and that was my PTSD counsler. He makes it a point to keep in contact with me at least once a week. One stressor is easily verifyable because of records, the other 2 are not due to the nature of the incidents and the cover-up's of the people in charge of the Units I was supporting. I was a Scout Dog Handler and supported many different Units.

Needless to say after reading the article in Watchdog and knowing I'm now waiting for a rating decision on my numerous claims I got spooked and needed reassurance from fellow Vets. I really did not mean to start a rucus.

Sorry,

OL'MAN

Ol,Man

You know I think I have a PTSD stressor. A dog handler lost control of his dog one night on guard duty. I was asleep inside a bunker. The dog jumped into the bunker with me. I woke up looking into the deep black eyes of what looked like a wolf. I about wet myself. The dog guy got his animal under control before it ate me. These kinds of things happened so often it makes me wonder who the real dangerous people were in Nam, us or the enemy. The dog handlers had the worst job walking around the small air base I was at. FNG's would sometimes fire at them by mistake. It was pitch black out there and you would hear the dog handler coming very slowly towards your bunker calling out to make sure he did not get shot by one of his own. The would stick guys out there with their M-16 and not even tell them to expect a dog handler to come by at 2am on his rounds.

Ol Man you didn't start a ruckus-at all - I did.

I can relate to all you said. I was volunteer in a Vet center and they voted me into the PTSD combat Rap group.1984.

One of the Nam vets called me up for a special PTSD group meeting one night -he was finally going to reveal his stressor to us all and wanted us all at the Vet Center.

He already got 100% for PTSD but wanted us to finally know what happened. It was horrible.Another vet opened up that night too on one of his stressor and that was terrible too.

I met my husband at the vet center and he was pretty focal about his stressors, but told me not too long before he died that he had never revealed to me or anyone the really horrible things. He said he would not even tell the VA-they were of unspeakable horror.

I was shocked because I had no idea he still kept stuff in.

The 'stuffing' of the stuff is what causes PTSD to be so disabling for many vets.

and it wasn't like you all got a great welcome home to the 'world' and a receptive audience to what your TDY was really like.My uncle forbid me to even mention Vietnam in his house due to 2 losses in the family.

I sure have no doubt of what you went through and certainly have had personal experiences with vets who cannot bear to talk about certain things.

We hopefully will be doing some more shows at SVR on PTSD soon.

You only need one stressor confirmed -not all three.Once they confirm one stressor -they dont look any further at JSRRC.

We have new members here and I need to remind them-I am a civilian but Vietnam is still an important part of my life every day and it would take a short book to tell you all why.OK a LARGE book.

The Vietnam War altered me as a civilian Forever. It is why I am here at hadit.

It caused me to realize that the 'world' had become dinky dau-if you catch my drift-during the war-and this added to the problems you men and women had when you came back.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
