Judge Grabbing Any Law, Punishes Veteran
This is the short version. Lee County, Florida Judge Margaret O. Steinbeck, Former Military lawyer, avoided the use of a veteran's disability compensation benefits as alimony, in Fisher v. Fisher citing, " USC 38 sec. 5301 is a general statute which prohibits assignability, levy or seizure." Having avoiding conflict with federal law, using her status, and the authority of her court to inflict her punishment to the veteran, in the only other way that she could, because Mr. Fisher argued federal law precludes VA disability benefits as an award of alimony, Judge Steinbeck goes after his Social Security disability compensation. Citing, in Fisher, her Memorandum of Law, USC…

Ssdi Question On Time Differences.
I finally applied for SSDI on the 4th of May. I took in all of my VA records and award letters, and even the letter from the Voc. Rehab office stating that I was ineligible for VR because of my disabilities interefering with school or work. The paperwork I recieved at the interview stated the usual 180 days for a decision. I'm awaiting a return of my Birth Certificate, as the SS had my birthdate wrong, and my original birth certificate, stamped, is no longer valid to state who you are. They have to pay your state Vital Records for a new copy. So I got a letter this week stating that once they recieved my BC they would make a decision with in 30 days. Anyone ever …

No Word On New Claim,
I've allready been denied by the ALJ and appealed to the review counsil. But, I also filed a new claim because my time will be up to apply before the council makes a decision. It's been 5 months and I havn't gotten anything. No questionaires, forms, appointments for exams, no nothing. I had to call today just to make sure the claim was pending because I thought they may just have the review going. But they are both pending. I have included more evidence and doubt very much that I could be denied this time around. My VA comp (100% P&T) is sent to my wife because two psych MD's said I am unemployable and may forget to pay my bills because of my dementia. The ALJ i…

? For Berta Re: Lejeune Water
In response to my last post... Berta, Here's the thing. Normally, kidney tumors that are cancer (and most of them are) occur in only one kidney. Art had tumors in BOTH kidneys. When they occur in both, it is either genetic or environmental. The doctors at the Cleveland Clinic suspected he had Birt-Hogg Dube Syndrome, which is a rare genetic disease. They sent him for thorough testing at the National Institutes of Health in Bethesda, MD. After two lengthy visits there over a span of two years, and DNA testing of his tumors, they RULED out a genetic component. We have all the paperwork. What does BVA stand for? Thank you!!!

Anyone Get Va Disability As A Camp Lejeune Water Survivor?
I posted the question below about my husband's kidney cancer. We just ordered his military record so we can see just when he was at Lejeune. Next step is to pursue the VA disability. (He already has SSD). My question is: Was anyone out there able to get VA disability based solely on injury (delayed ) from the water at Camp Lejeune?? We have already sent info to the attorneys doing the class action suit re: Camp Lejeune. Thanks for any input at all!!!

Have Ssd, Try For Va Disability? Kidney Cancer
My husband has had a long history of kidney problems, tumors, that turned out to be kidney cancer. Both kidneys involved. Had 9 surgeries, and got a new kidney from his brother last year. He has been on SSD for about 2 years due to kidney failure/kidney cancer. During this time, I discovered the possible link to his military service. (He was in Marine Corps from 84-88. He was at Camp Lejeune during 1985 (not sure the exact dates, how could I find that out?) where the water toxicity was bad due to the dry cleaning fluid in the water as well as the fuel spill. Questions: Should he apply for VA disability? How do we get started? He wants to go back to school,…

Ssdi Hearing : Need Advice
Hey I need some advice please. The Social Security judge just turned me down based on a letter my attorney had prepared for him. Now I have a hearing set for mid next month and I am not real sure what to prepare for. If you could please help me, Thanks! For my VA claims research I used Hadit heavily. One of the pieces of advice I received numerous times was for the C&P’s. I was told, and believe, that you should show the VA in a C&P exam the way you are on your worst day. We all have good and bad days, but don’t dress up in your Sunday best or shave for a couple of days and tell the truth. I followed that advice I have very favorable results in my case. …

Approved Today For Ssdi !
Got my "NOTICE OF AWARD" letter today for SSDI. Applied 5 months ago and won on the first try. I am so happy. This is a big relief off my shoulders. They say I will get a check for my retro on Jan 5, 2007. My claim with the VA is currently at "Ratings". I have no idea how long it will be there. Should I wait for a decision to see if I get SC for my heart or should I contact my SO and submit my Award letter now. Also could anyone tell me when I will get Medicare? Is it 2 years from when I became disabled on Jan 25, 2006 or is it 2 years from my entitlement on July 2006? Any help would be appreciated. Thanks, Brian PS I am learning so much from hadit.com and …
