Regional still screwing me
Hello everyone. I am Juans's wife. He currently does not have computer access and cannot read or write on the message boards from his phone and will have limited access for the next several months. We received a letter asking for form 21-4192 from last employers. Firstly, all the previous employers are no longer in business so it is virtually impossible to get anything. Secondly, they should have had all this a long time ago because he submitted documents from the previous employers that he was not injured during any of those jobs. I thought the last request for documents was the final one and they were supposed to provide a decision in 30 days. I do not know what to do a…

DRO APPEAL awarded but not retroactive to Original claim dates
Time Line filed initial claim July 2011 awarded in August 2013 filed NOD September 2013 for increase of three disabilities 1 rated at 10% other 2 rated 0% 1 denied received C & P exam August 2016 awarded 20% and 10% and 10% increases September 2016 Radiculopathy denied however an EMG dated 2012 confirmed it, only Xrays and C&P I'm searching for the proper legal terminology or can I state in my own words my reasoning for the earlier effective date as my original claim date? The 3 disabilities were all previously service connected. It's just hard to understand how you can file a DRO on your initial claim and they take 3+ years…

ptsd How long should a DRO take
A bit of history...I filed for PTSD (medic in Vietnam) about 2 and a half years ago in San Diego. I got my decision fairly quickly and got 50%. My counselor at the Vet Center told me I should file an appeal for 70% and submitted his write-up with it (wasn't available when I initially filed) I requested a DRO review. Soon after, I moved to Florida and a few months after that I received notice that my DRO request was at Saint Pete's RO. I haven't heard anything for about a year and a half and e-Benefits just states the appeal is in process. Should I just consider it lost in the shuffle and submit a new claim or just continue to wait? Also, I always thought a DRO stay…

BVA Docket Number Assigned
All, I just received an IRIS response to an inquiry about my BVA appeal for ankle contentions. It indicated that on 2 June 2015 a docket number was assigned to my appeal (form-9), It’s been 3 months, should my BVA packet have been certified by now and sent to the BVA? How long does it take the RO to certify appeal packets?

Acted like my anxiety wasn't.........
I noticed that the VA didn't award me anything for my anxiety. I was diagnosed with PTSD, depression, anxiety and MDD all at the same time. I looked through my records and see where it's all listed. It has been less than a year since I received my award. Can anyone tell me how to go about getting my anxiety added into my disabilities. Do I file an appeal or..........

Can expect a favorable outcome?
Requested a DRO review and and the VA finally did another C&P exam that had a medical opinion this time (last C&P exam did not have a medical opinion). The C&P examiner stated "The condition claimed was at least as likely as not (50% or greater probability) incurred in or caused by the claimed in-service injury, event or illness." The examiner gave a clear and reasonable rationale for his findings that my service records shows a history of the disability ect... I read my entire C-file and there is no negative or contradictory evidence in there. Nothing is always certain especially with the VA so my question is can I reasonably expect a favorable outcome?

Decision regarding entitlements
Vet's I got my decision letter 9 /11/16 on the following and have a few questions as to how to proceed with a NOD but first I wanted to ask; if I get a retirement adjustment, compensation rating adjustment starts from May 1 2016 to present and change from $1680 to $1888; how long do it take to get my retro pay? Now about the decision: I been fighting Fibromyalgia and CFS for over 5 years now. I've been denied every time. ptsd Need new attorny that can help with my claim, any referrals?
My current "big name" legal team, seems to have forgotten about my claim and are too busy to return my emails. They've had my C-file for the last 6 months on a slam-dunk PTSD case. Is this a normal experience from those who have gone through this before? I would appreciate referrals from anyone that's had a positive experience with an Attorney that get my case closed with the VA. Not sure what worse, the stress and effects of PTSD or the relentless grinding trying journey of getting awarded your claim. Your help is appreciated.

fibromyalgia and OSA
Impression: 57 y/o with polyarthralgias and high positive ANA (1:1280, speckle pattern). His MSK symptoms suggest OA, especially with his H/O previous trauma and injury to his joints. He could still have seronegative Sjogren's syndrome. I think that he has fibromyalgia as a result of OSA combined with chronic pain from OA. I favor that his inability to wake up feeling rested is aggravating his symptoms. How can I use this information to cliam FIBRO. It has a lot of gray areas and the doc has already departed for a civilian job.

IBS Claim Queston
I recently submitted a claim, 09/28/16, for IBS (presumptive to Gulf WAR) and dysthymic disorder. Had C&P exam on 11/16/16 and EBenifits shows Claim Complete on 12/24/16. Received BBE on 01/02/17 only addressing dysthymic disorder (Denied, not SC). There was no mention of IBS and it does not show up at all in my Ebenefits. I should note that C&P exam results clearly note my IBS and referenced my Gulf War Service. Called 1-800 # on 01/02/17 and was informed information on IBS was mailed on 12/21/16 and had to wait 10 days to request copy.
