  1. You have to pay for the extra 20,000 if you are on waiver for the first 10,000.
  2. Is one doctor going to do all these exams? Each condition has a separate exam schedule as far as I know. An exam for the heart is specific. Who is doing the feet?
  3. If the VA has more than one claim in the system for you they do sometimes rate them all together and send one rating decision on all the issues. They wait until all the issues are ready to rate and then rate them. You still get separate ratings but they are combined in one decision.
  4. You have to take them by the hand and show them everything and every connection. Unless the disability is presumptive you have to prove it via the medical evidence and your SMR's. You are supposed to get the benefit of doubt but only in a case of a very close call. When it comes to chemical exposures what I have seen is that the burden is on you.
  5. Matt Yes, you can get a lawyer to represent you at the BCMR. There are experts who do this kind of thing. Your rights were probably not well represented since they consider vets with bad paper to be the enemy. If you can prove you should have gotten a medical discharge you might be eligible for a pension.
  6. I got the VA to pay for some of my dental work. They paid a certain amount. They paid the bulk of the cost but not all. 7000 is a lot of money. That is good.
  7. Did you have a lawyer? I may have told you my experience with this board. They are not friendly to vets without expert legal representation. They are afraid you will ask for money. There is just no way a young and scared soldier can stand up to the weight of UCMJ. You never had a chance then. Now you have to hire a lawyer if you want to win this thing.
  8. You need to say that your SC disabiilty makes it impossible for you to work. You will need to back that up with medical proof as well. If you have a letter from a doctor saying you can't work solely due to your SC then that should work for you. You need to do the TDIU form.
  9. When you talk about staged ratings this is a big deal for those of us who have CUE claims going back many years. Even if we win the VA may stage the rating percentage. Any way to cheat a vet out of some retro is sop.
  10. I got a transcript of a DRO Hearing. The transcript left out the part where the DRO Officer agreed with us. I had a lawyer.
  11. I think you need to be sure about c&p exams being available without having to come back to the USA.
  12. You need doctors who are willing to stick their necks out a little bit. Don't expect that from the VA.
  13. Getting to the point where you get a C&P exam is the major hurdle.
  14. You know an abnormal gait could be a cause or effect for all sorts of problems. If you have pinched nerve in your back it will make you walk funny and if you are walking with adnormal gait due to some foot problems it could affect your back. What is the cause of the abnormal gait and then you can get SC'ed for secondary conditions if you can get a doctor to go along with your reasoning. Just remember you have to prove everything with medical evidence.
  15. I think the testosterone thing may be the newest fad and money maker for the drug industry.
  16. The NOD is your notice of disagreement which can include reasons why you disagree. That is usually not enough to win a denied or low balled claim in and of itself. The NOD is the first step in the appeals process. One thing to remember is that claims take time. There is just no way around it. Even claims for presumptive conditions take time because you may get low balled and have to appeal.
  17. If you get a DRO Hearing and fail you can still go to the BVA.
  18. Your situation is the one we have worried about with PTSD claims. You somehow need to get the VA to give you a PTSD DX. The rule change to liberalize PTSD claims has now come back to bite us all in the ass. The VA says they are the only ones who can make PTSD DX.

  23. I think what you want to do now is so how severe your PTSD is and how it affects your daily life. Let us know when you get ready for your C&P exam.
  24. Ham There is no automatic 30% PTSD award for having a CIB. If you have a CIB the VA will concede your stressor. You don't have to prove you were in life threatening situations. The person who does your C&P exam does not make your rating.
  25. Commander Bob's PTSD claim was denied even though he got his leg blown off in Vietnam under the most stressful conditions. His claim seems self evident. He and his fellow troops walked into a minefield. Talk about stress. The VA said he was anxious. Yeah, I guess so. His claim is going to the BVA because the VA has dug their heels in saying he never claimed PTSD while in the service. Can you imagine such reasoning? Maybe he will correct me, but I think I have it right.
