If you have access to Ebenefits, then go on there and begin a new FDC claim, you will then be able to click on your denied conditions. It will say Reopen, and then fill out and submit the claim from there. Either get your original evidence together, or new Medical Evidence such as New Diagnoses or Current Treatment Records. I really wish I was an expert as a lot of the Smart Folks on here, but really I learned a lot from making so many dang mistakes in the beginning. I also like to help Vets a lot with their SSA claims, as that can be a pain in the rear too. Thanks guys for the kind words and hope you have a good week.

It is truly hard to say, but in my case, I didn't do NODs. I went thru the VA Claim process, and when they denied or low balled me, I turned right around and re opened or requested an Increase, and 90% were granted. I myself am not an expert on the Appeals process, but believe that Good Well Documented Evidence is all that is needed without the Appeals route. I have found that 99% of the Vets I help, and myself included do not do as much Research and Documentation in the first go rounds as we should. Thanks to Hadit and reading the VAs policies and wording, I have gone on to have great success in just a few years with the VA and SSA. Hope you have a good week

Pete, thanks for the info, and as stated above we Have to fight for the Pennies while these Uncaring, Bean Counting, Living Better then Us on a Bad Day, and yet they get Away with Everything to Include Basically Man Slaughter, Just don't get it my Friends, and I apologize if my words are Offensive!!!

Congrats on the great news, and I agree with above, as long as all of your Disabilities are SC that you might one day die of, or if you are young enough to make it to the 10 yr mark, so there is no issues for you spouse to receive Benefits, God Forbid something happen to you, then go for the IU. I just went thru this recently. Where the VA reviewed all of my conditions in Feb 15 but I was not up for Review until Feb 2016. Well went thru the initial exams and VA actually increased Migraines to 50% and continued the rest. Well in June 15 I saw a Claim on Ebenefits that stated the same statement. So the VA sent me to a Heart Doc at VES to Review my last 2 Original Conditions Scars and Tongue Damage. Went thru the exam and then recently claim went to Complete, and I went from 100% T&P to 100% P&T, without asking for it. So it could be a good thing for you my friend. Good luck and keep us posted. Sorry to say bud, but 11 days is a great warm up for any claim FDC or not. Also the info that the RO is looking for from you VA that you receive Treatment at, they need nothing from you. Same thing happening on my last claim, the VES Review Doc was slow as hell, I went thru this over and over again for 3 months. Your claim will be done soon enough bud. Good luck and keep us posted

Just my opinion, submit all as an FDC and add IU to the claim, as PTSD 70% alone can grant you the IU. Get the Buddy Letters as they always help, and just make sure that you have either been Diagnosed/Treated while Active, or since left thru the VA Docs. Also have you submitted for SSDI in your state? So then you had a DWI, and wonder about misconduct. I was stationed in New Orleans, so believe me DWI and DUIs are very common there. I was involved with so many Court Marshals there it was ridiculous, and quite frankly I was tired of them. Again no one is taking from the fact that you were in a wreck and injured. Me nor anyone on here would like to see anyone hurt, whether they are braking the law or not. I just don't think that you get the overall picture. A lot of Vets have been hurt in multiple negligent ways to include Drugs, Drinking or Violent acts. The VA or DOD did not wish the hurt on them, yet will battle the Vets toe to toe if they try to seek compensation for what the Service Member caused not the Govt. The air bag did not deploy, which is a bad thing in itself, but if you were not driving to begin with, no injury or miss deployment of bag would have occurred. What are your current 30% VA for? Is it bad enough that you can submit an FDC for an increase? We are all just trying to figure why you are going after the Govt when it is not their fault. Are you currently receiving SSDI, or working full time? Are you in such a need for extra income that you are willing fight a hard fought uphill battle? God Bless my friend, and I truly mean that.

Driving with an Illegal License is misconduct, that means that you knew not to drive, yet you did. A good friend of mine that I was stationed with was hit by a Drunk Driver and killed while active on a motorcycle. Guess what his Wive was not able to get his life insurance, cause he did not have a Legal License or Motorcycle Training.

When I was Active I had to kick out a few Vets that got hurt off duty, Riding 4 wheelers, playing sports and doing stupid stuff. The Military kicked them out as they were injured off duty due o Negligence. There after they would bot be allowed to file for Disabilities, as it was not the Navy or VAs fault they were hurt away from the Military. Same thing applies to you. I understand about the issues that multiple Car Companies have caused serious injuries and death due to Recalls, but that is where you go after the Car Makers in the Civilian World, not the VA.

Being that I worked in Law Enforcement after my 10 years active, you were Driving with a Suspended License, Right? So that means that if you were never illegally driving in the first place, then the accident would not have happened, and you would not be going after the VA to compensate you for your past record? I am not being rude or questioning your disabilities, what I am asking you is what the VA is going to say when they come after you. Wish you the best and keep us posted

I am 33 and was found not able to manage life and finances, and no weapons for rest of life. Does not bother me one bit, I have a great wife and daughters that will take care of me just fine. I don't get why so many Vets feel it is the end of the world if the VA or SSA finds us unfit for finances. Whatever it takes for you to get the Benefits you deserved bud. Congrats on the good news

They are correct above, but remember that to receive SSDI you had to worked within the last 5 years. I recently was helping a local Vet that missed the 5 yr mark by a few months. So he went back to work part time at a Hospital with patient services. After a year there, then he is going to resign and seek SSDI.

Boy do I know how you feel bud. I have gone to multiple VAs more then once, and had to return cause they messed up. BTW my VAs are over 200 and 300 miles round trip.
