  1. Not long ago me and some other disable veterans and our spouses got together in Nashville Tn, we stayed at red roof Inn fairly reasonable with 10%discount for us vets, We would go to a near by restaurant to eat , everyone/& couples went paid for there own ticket each time and any outside entertainment we just paid for it on our own...because some liked to do different things so it made it easier and everyone was happy. We would agree on a meeting place to meet an visit with other veterans and there wifes..we all had a very good time and I got to meet some great older country music stars and some younger ones too. A get together like this is somewhat different than a family reunion were everyone usually brings pot luck (food) and different ones is in charge of things like Ice/Bread/Water ect,,,ect,, and your usually at a lake and have the pavilion to set up /electric to have Refrigerator/Frezzers for refrigerated foods from the locals. As for as how long...no time limit everyone was free to stay as long as they wanted to we stayed 3 days Friday thru Sunday....some stayed longer just depends on what one can afford and how long they choose to stay.(most of us will probably fly in & some I'm sure have RV's to travel & stay in. We did this once in Las Vegas too...that was fun trip..but if your better off staying out of those nice lighted casinos (lol) I vote for the Florida Trip at the Green Resort jbasser mention. but to us its really what the majority wants to do....just not a cold climate! I am not sure on the dates (hopefully summer time) but if its a year or so from now that will give us time to save up for it as we live from payday to payday.... .....................Buck
  2. Ms Berta, I never trusted ebenefits to many mess-ups with it for me. its more convenient but is it worth the stress when something goes wrong or they delete/lose some important documents. eh!.....jmo ..................Buck
  3. What is the age limit for the children of a Vietnam veteran? if any? and if the Vietnam veteran don't have any presumption AO disease but his son/daughter does with no military can they file a claim? I always wondered about this? ................................Buck
  4. yes, however you may want to check out your disability to see the % if it gets worse or has gotten worse? check out hadit's disability % chart to your disability/s jmo .................Buck
  5. That's 231.00 monthly....is the way I read it. 231.00 x12 months 2,772 I think it depends on your income? ..............................Buck,
  6. lumbar spine is your lower back! sorry I don't think its a CUE. NOT S.C. in Nov 2004 PREDISCHARGE EXAM! but was 20% S.C. on June 6TH 2014 Recheck your SMR's \ \...............jmo .................................Buck
  7. Prejudice has nothing to with do it! I don't care what color he is As long as he does his job as commander in chief and gets America back to its feet & running strong rebuild our military& take care of our people! ................jmo .......................Buck
  8. Take records '' SMR'' to your C&P incase the Dr don't have them! However the records must show a stressor or stressor's while on active military duty. Traumatic stress while tending to the wounded civilian's /children you may need to go into detail with the C&P Dr. you might consider a IME/IMO and ask the private Dr to address the stressors ''it is as likey as not caused by the traumatic experience while in the military or something close to this!...check out hadits forums about PTSD Stressor's. Good Luck jmo ...................................Buck
  9. I think Robert (Bob) McDonald is doing a outstanding job with what he stepped into. Although he maybe a little slower now answering emails I can only imagine he is flooded with them! We all need to support him and show him how much we appreciate what he is doing for the/us Veterans I personally think he is the Best Secretary of VA we had in a Long Long time! jmo ................Buck
  10. I agree Ms Berta, We all need to stay one step ahead of the VA...:Paying Close Attention to all claim document's dates and what it says! You do well with that! .................Buck
  11. Congratulations. 90% is pretty much total disabled...I would try to get another 10/20 % to get the 100% rating and possibly P&T Especially if your married with children....spouse can go back to school and you spouse gets chaper35 champVA Insurance Military ID card for you and your spouse...and the property tax exemption is very nice. Being 100% P&T opens up a whole new world out there for you and your family. jmo ......................Buck
  12. I personally ''think we have a sissy for president''.... NOT to take a stand against the Russia President proves it...not that I want us to go to war with them but at least let them know they are not going to push the USA around....I think a US President should defend this country tooth & nail...stand up for what's right. In any war or conflict there's going to be injury's and casualty's and all us veterans are suppose to be taken care of.....when that starts to happen is anybody's guess. jmo ..................Buck
  13. The VA is cracking down on the pain meds and I suppose it makes the Dr's pissed off. This New DEA Law is why....and if the Dr's don't go by the rules I imagine they get the boot?...some pain meds like Hydrocodone is suppose to have VA doc sign off every 28 days that they seen you or tested you...there getting pretty strict with it. they basically have to cover there self. jmo .................Buck
  14. http://www.hadit.com/forums/forum/80-agent-orange/ scroll through the AO Forums & maybe you will find what you need? ..........................Buck
  15. I am not sure why some have there records digitized and some don't, maybe its just random who ever gets there records digitized ? For those of you who are pending claims you guys better request to go see your c-file before a lot of records get lost. (due to the change over ditized) ASK FOR IMPORTANT COPIES & THEY ARE SUPPOSE TO GIVE YOU FREE COPIES DITIZED or not its better to have copies of everything and date stamp if you possibly can and date you actually got to view your c-file. if you go to your RO to view your c-file and its not there then ask for a form called ''report of contact'' date stamped sign by a VSO Always take important documents with you to a DRO Hearing never on a smart phone or computer ''like ARng11 mention they won't let you use it or neither will they look at it (Bring your papers with you) any new medical evidence to help support your claim. jmo .............Buck
  16. Yes your P&T VA uses this CFR's to award the TDIU P&T... (Read) both paragraphs! §4.16 Total disability ratings for compensation based on unemployability of the individual. (a) Total disability ratings for compensation may be assigned, where the schedular rating is less than total, when the disabled person is, in the judgment of the rating agency, unable to secure or follow a substantially gainful occupation as a result of service-connected disabilities: Provided That, if there is only one such disability, this disability shall be ratable at 60 percent or more, and that, if there are two or more disabilities, there shall be at least one disability ratable at 40 percent or more, and sufficient additional disability to bring the combined rating to 70 percent or more. For the above purpose of one 60 percent disability, or one 40 percent disability in combination, the following will be considered as one disability: (1) Disabilities of one or both upper extremities, or of one or both lower extremities, including the bilateral factor, if applicable, (2) disabilities resulting from common etiology or a single accident, (3) disabilities affecting a single body system, e.g. orthopedic, digestive, respiratory, cardiovascular-renal, neuropsychiatric, (4) multiple injuries incurred in action, or (5) multiple disabilities incurred as a prisoner of war. It is provided further that the existence or degree of nonservice-connected disabilities or previous unemployability status will be disregarded where the percentages referred to in this paragraph for the service-connected disability or disabilities are met and in the judgment of the rating agency such service-connected disabilities render the veteran unemployable. Marginal employment shall not be considered substantially gainful employment. For purposes of this section, marginal employment generally shall be deemed to exist when a veteran's earned annual income does not exceed the amount established by the U.S. Department of Commerce, Bureau of the Census, as the poverty threshold for one person. Marginal employment may also be held to exist, on a facts found basis (includes but is not limited to employment in a protected environment such as a family business or sheltered workshop), when earned annual income exceeds the poverty threshold. Consideration shall be given in all claims to the nature of the employment and the reason for termination. (Authority: 38 U.S.C. 501) (b) It is the established policy of the Department of Veterans Affairs that all veterans who are unable to secure and follow a substantially gainful occupation by reason of service-connected disabilities shall be rated totally disabled. Therefore, rating boards should submit to the Director, Compensation Service, for extra-schedular consideration all cases of veterans who are unemployable by reason of service-connected disabilities, but who fail to meet the percentage standards set forth in paragraph (a) of this section. The rating board will include a full statement as to the veteran's service-connected disabilities, employment history, educational and vocational attainment and all other factors having a bearing on the issue. [40 FR 42535, Sept. 15, 1975, as amended at 54 FR 4281, Jan. 30, 1989; 55 FR 31580, Aug. 3, 1990; 58 FR 39664, July 26, 1993; 61 FR 52700, Oct. 8, 1996; 79 FR 2100, Jan. 13 2014. Although your 70% rated. your combined rating sc is 70% your being paid at the 100% rate...making you 100% P&T using the extra scheduler from the CODE OF FEDERAL REGULATIONS 38 U.S.C 501 (a)& 416(b) And yes you can apply for the property tax exemption and all the other benefits that come with a 100%P&T Rating and also later if your disability's worsen you can apply for SMC/s special monthly compensation depending on the severity of the sc disability. Congratulations btw ...................Buck
  17. yes great news congratulations ............Buck
  18. This Is just ''one'' of my reasons I don't use ebenefit's! Grrrrrrrrrrrrr .................Buck
  19. Unfortunately some Non-Friendly ''VA doc's'' at a C&P Exam will write up some off the wall BS to try to reduce the veteran.... all that is said in a C&P Exam is not what the Dr writes down, this is why its important to get those exam records As soon as possible. It happens to a lot of Veterans. I never figured out why they do that?? but I suppose its some kinds of ''power thing'' with them AH.s. ........................Buck
  20. congratulations 80% is a good rating. take some time to enjoy and like the others mention at 80% you should have been inferred TDIU Claim. It means if you can't work because of your 80% S.C. disability's then they rate you TDIU & Depending on the severity of the disability they rate you P & T.....(I had to ask for my tdiu.) Its also a big jump in monthly Pay and Extra Benefits. & file for SSD...with that and iu makes for a modest tax free income. I realize your tired of fighting with them, but if you can't work because of your disability...file a TDIU Claim. jmo .......................Buck
