    My believe is that there is an underestimation of what this can do to future claims. This is really setting up a lot of claims to fail (if this goes through).

    I highly recommend seeing Dr. Jaclyn H. Polsky if you need an independent medical option to go with your mental health claim. 
    I saw her work and is very detailed and she has a ton of experience working with the VA.

    Since this is in your records, I would go forward with a claims package that includes a detailed personal statement, buddy letters, and I would include some medical journals off https://pubmed.ncbi.nlm.nih.gov/ that related to your case.

    Direct VA upload is now open to the Veteran, where in the past this was just for the VSO's or lawyers.

    Now you got to fight! You got to build a good supplemental claims package.  What should this include?
    1. Solid Independent medical option Nexus
    2. Lay evidence- great personal statement/Buddy letters.
    3. Medical journals -- https://pubmed.ncbi.nlm.nih.gov/
    4. BVA court cases similar to yours. 
    Combine that into a package and submit a supplemental appeal. 
    Just my option on what I would do.

    I'm torn on this one to be honest. 
    Con:
    Really hard to get your results in a timely manner compared with a VA C&P exam that is uploaded to myhealthyvet
    Pro:
    I feel like VA C&P examiners are jaded by the process because they have been doing it for years and that's all they do. Plus it seems like at times they're "Protecting" the VA's money.  A contracted doctor is just on a contract to do a job and bail, they have no vested interest.

    Very interesting! I'm seeing that many people choose to go right to the BVA and I do understand that for sure. In my option since they changed the appeals system to this new HLR/Supplemental/ BVA path it benefits the Veteran more to go HLR or supplemental before the BVA route. Why? Time of claim. On average supplemental and HLR's take about 4-5 months, why not get some additional evidence or write a great rebuttal letter and try the HLR/Supplemental route before the BVA? I know the BVA stats are better but there is a chance the Veteran can win at one of the lower levels before going to wait in line at the BVA. If the HLR or Supplemental route does not work they can always go BVA?

    Hey Fellow Vets, 
    Let's talk about high level reviews! Once your claim is denied or you think you should of been rated higher, you can request one of three appeal lanes (HLR, Supplemental, BVA).
    One of those appeal lanes is called a high level review. You can add no new evidence to a high level review (No new med records, IMO's)  but  you can request an INFORMAL CONFERENCE WITH THE HIGHER-LEVEL REVIEWER.
    This is what I want to debate! Do you do the Informal conference or not?
    In my option, No! The word Informal makes that entire call questionable. When dealing with the VA, you do not want anything informal! 
    Also that call push's your timeline out on your appeal plus are you really going to be able to articulate yourself correctly in under 15 minutes? 
    What you should do instead is when turning in your high level review form you can add a VA Form 21-4138 explaining why you deserve a higher rating or why you think it should be service connected.  This will be official and will be reviewed by the rater.  You can take your time and craft your argument based on things like CFR's,  probative value and outline the evidence in your file. 
    LETS DEBATE!

    1. Have you been receiving treatment for your PTSD?
    2. The most common way to link sleep apnea to PTSD is through the PTSD causing obesity, then that obesity causes the sleep apnea. Even with an IMO it is still a difficult claim to win but not impossible. I am service connected sleep apnea secondary to MDD. It take a bit of a battle to get it though.

    It's at your discretion. Some people would recommend not to pursue the appeal, Some would recommend to continue. 
    If you were granted 100% recently, I don't think you would be penalized for it if you continue with the pending appeal. Usually, administrative review is done within 5 years of a granted claim. I'll double check though.
    My suggestion would be to continue with the pending appeal, because the ratings are capped at 100% anyway, but if the appealed claim is granted, it could be added on for SMC; depending if it meets SMC criteria.

    "VA"  and "Office of Communications" is a contradiction in terms.   Its sort of like, "Jumbo Shrimp".   Which is it, Jumbo or a shrimp?  Or, "Military Intelligence"...which is it, the military or intelligence, it cant be both?  
    The VA works VERY hard to make sure they dont comminicate with Veterans.    If they want to ask something, they ask a VSO.  Of course, VSO's dont return our calls, so the VSO tells VA what other VSO's think, who also dont return Veterans calls.   In this way, the VA makes sure that nothing the Veteran ever wants is ever implemented.

    I did not use these guys but I did speak to them on the phone.
    www.reemedical.com -- They are a company that can get DBQs filled out for you. There focus is the joints.  Up front $1775 flat fee for all DBQs.
    Veteranrating.com -- If you go here and fill out some info they can recommend medical consulting company's to work with.

    Call (202) 530-9470 and Post your answers ask them what's going on O Calle after one month I had a hearing after 3'months no Hardship either  just talked about my issues. If you get answers please post I'm trying to promote these guys and increase their workload there's only 4 of the I know all of their names just from calling. They can help you get answers this number was given by one who was the head of a correct a claim by Ms Hickey whose no longer in here spot but they still help everyone tremendously... call and post I'm increasing my chance of not getting answered but if you get help I'm happy
