tdiu Urgent Help Please - New Claim
My fellow Vets, I currently have a dilemma, and any useful ideas would be GREATLY appreciated. I'm currently 60% for GERD but my total compensation is 70%. I was working but my GERD was so bad and caused me to take a lot of days off, the symptoms of my GERD and other VA ailments caused me constant depression and daily anxiety. Due to these circumstances my VA Mental Health Doctor wrote a letter to my supervisor(federal job) stating I need to take time off to deal with my mental health issues. Now I'm coming up on year of being out of work. During this time I have been receiving frequent treatment from the VA and I'm on numerous mental health meds. I had depression…

Wife Denied On Everything...
My wife was recently denied for every medical issue she applied for... She was enlisted in the Air Force for 4 years and then completed 2 years of Reserves. Her medical paper stack was thicker than mine and the VA sent us a letter stating that they could not make a single connection for anything. One issue that stands out in my mind is that she actually just went through foot surgery for a running injury she received in the Reserves. All paperwork documented. We went through a guy downtown DC who put together her package for her. He seemed very knowledgeable. What do we do now? I mean, I got denied for my bad knees even though I had went through physical therapy in ac…

0% + 0% = ?
I know I heard somewhere that two 0% rated conditions equate to 10%. Is this true? Also, what about situations where there are even more multiple 0% rated conditions.....like 3 or 4 of them? Just a thought. Mark

tdiu The Bay Pines Ro Is Hilarious
A few months ago I filed what I thought was a new claim for Bilateral Sciatica but the BP RO changed it to left leg pain due to sciatica (ILLEGAL!!!!) Yes I was denied because they changed it as a "Reopening" of a previous claim. This was my fault because I didn't have clear understanding of Sciatica and Radiculopathy. I thought they were two DIFFERENT components/causes. JBasser set me straight on this. Anyway in their denial they stated nothing in the records shows it being from service and there is a diagnosis even though: 1. Dr. Bash's medical opinion (actually TWO opinions) NEXUS'd it as being from my service from a progression in my lumbar spine. 2. Pain Ma…

Will I Need To File A New Claim?
I posted this in another forum, but maybe that wasn't the best place to ask the question. So here goes: I am scheduled to have a total hysterectomy to correct the pelvic organ prolapse in April. I am currently 20% disabled for TVT bladder sling and they attached a cystocele/rectocele 0% rating to that. I also have 30%for migraines, and other conditions which are rated at 0%. (Non-GYN) for a total rating of 40%. My question is how will the hysterectomy affect my rating and how do I claim the hysterectomy after the surgery? The hysterectomy is to correct the cystocele and rectoceles and pelvic organ prolapse. It will not be removing or changing the bladder sli…

Basic Question About Records Collection For A Disability Claim
Folks: Although I filed a FDC Claim with all of my DOD, VA and Civilian Medical Records and all were provided to the Regional Office "hard-copy" , I was under the impression that VBA still automatically requests a Vets Service Medical Records (SMR's) from DOD as well as all of the VA Records to be loaded into the new VBMS System because of the "Duty to Assist" Requirements - even if it is duplicating the records that I've already sent in and they have? IS this True? Recently, "ebennefits" is saying that I need to load even more evidence? So, I called the 1800 number and was told that it's their (VBA's) requirement to get the evidence that is being referred to …

Disability Opinions
Hey everyone, I am new here and in a state of confusion. I am having issues with the possible "MEB" process being thrown in at my separation. I have been going to physical therapy for the last four months for my back, shoulder and feet. I was diagnosed a month ago with two lower disc bulges and immediately after that they stopped my therapy. I am getting mixed information from the Medical Clinic here at Bragg and I am not sure if I will get MEB'd or if I will have to file a VA disability claim. I am looking for any help or information on what to expect because I am not getting much from the clinic (unless you count confusion). My back and shoulder have been documented…
