ptsd Do I File For Iu, Or File For Permanent & Total
Good Evening, Most of you on here know me and my medical conditions well. The question I have is, I am 100% Temporary, and I am trying to decide whether to file for IU or Permanent. I currently have an open FDC for 6 or 7 other conditions. I have tried to help so many Vets on here, but I am so scared to file for myself. I am just so used to the VA and the Govt trying to lower are %s. As you guys know I also was approved for SSDI back in Feb 14, in less than 10 weeks, and my wife is paid to be my Care Giver from the VA. I have a Mental and Physical Capacity form filled out by VA Docs that says that I can not hold employment due to Physical and Mental Conditions. Below …

ptsd Nod-Dro-Post Dro-No Soc-Bva-Back @ Vamc: Can Someone Help!
I post on here infrequently but, love some of the knowledge/advice giving. Here it is. PTSD 70%, Migraines 10%, and Ring of the Ears 10% for a combined service connection rating of 80%. I was denied an increase to IU 30 Nov 2011. I submitted an NOD to receive a DRO dated 25 Jan 2011. I was never contacted about a decision or giving a SOC. I'm going through the appeal process with an American Legion VSO. I then received a letter from VARO on 10 APR 2012. The VARO acknowledged my NOD claim. They contacted my previous employer (USPS) and acquired copies of disability medical records from SSA. I receive SSDI which is reviewed every three years. I receive a Federa…

tdiu Slightly Above Poverty Level.
I know I have read other case where TDIU was granted when a person was employed marginally in a sheltered typed work environment. Most responses about TDIU state that you can not work--however the following info from a case states things a little differently. I am marginally employed in a sheltered environment. TDIU was recently denied as I am a few thousand dollars over the poverty level for the past 12 months. The reason I am over is that I have a decent hourly wage--although I am working about 10 hours per week or less. Quote from below: Marginal employment may be held to exist, on a facts found basis (includes but is not limited to employment in a protected env…

tdiu Tdiu Filing Within One Year Of Decision
I received a "split decision" on 5/1/14 with an effective date of 8/24/12 for all but one condition and 1/15/13 for the remaining one. On the advice of the MHCS case worker, I applied for TDIU. Since my most recent contract expired on June 27th, I submitted an informal to get the TDIU ball rolling. In a situation like this (requesting TDIU within a year of the original decision), is the effective date still the date of the TDIU submission or is it retroactive. NOTE: I attempted to infer a TDIU in my original claim as explained below. -------------------------------------- After one C&P exam, I submitted a 21-4138 showing I made no more than $8,700 in the pa…

diabetes Confused Regarding New Packet Received
I just received a new packet in the mail requiring a reply within 30 days. Basically they are asking for all the same evidence that has all ready submitted. I.E. SSD status.Approved, I took that directly to the Regional Office with my case number on every page. They copied and date stamped for me as received. Letters from my previous employer, which they all ready have. Etc. Etc. Etc. It even says that they are going to schedule another examination by the VA, which my service Officer previously said they would not do. I am currently 80% (70% PTSD and 10% for Diabetes Type II) I'm beginning to wonder if I should get a lawyer at this point. I all ready have the SSD,so now…

ptsd Iu Claim Awaiting Decision Approval W/o Scheduling Me A C&p For Iu
8/1/2013 filed for an increase for PTSD on at 30% (overall SC 40%). 10/15/2013 C&P exam for increase - Examiner stated I was unable to be employed due to SC in his report and was very helpful to my case. 1/5/2014 approved increase for 70% PTSD with new diagnosis of MDD secondary (overall SC 80%). IU differed. 6/18/2014 ebenefits changed claim status from review of evidence to awaiting decision approval. Also a dependency claim from 3/13/2013 has changed to decision notification. MY question is, is it likely that them never giving me a C&P for IU is positive or negetive for my claim? Checked AB8 and nothing has changed so I don't believe they have updated a…

tdiu Those That Put Claim For Tdiu, If It Took Long Time For Decsion, Why?
Would those Vets that put TDIU claim in, and it took along while, do you happen to know why it took so long? the normal, VA claims just sucks, like everything else, or was it because they needed something, slow region, any tangible reason? I am really wondering what is taking so long, I put mine in last November 2013, and it is now almost July 2014. Usually I get a denial within 4-6 months.. Not saying I expect a denial, but it seems to be taking forever. I moved from the extremely slow California, to Oregon, and it appears Oregon is no faster with VA Claims. Thanx

Iu Claim & Anxiety Disorder
Hello all, This is my first post in the forum. I got out the service in 2006. I put in the anxiety claims in 2012; first the claim was denied and I appealed finally got 50%. After 50%, I disagreed so I appealed again for anxiety disorder in the past 2 years after VA granted with 50% in 2012. After 2 years waiting, I finally got the Cp exam a month ago for the appeal in 2012 . In 2014, I put in an claim for Iu and I know my criteria does not fit for Iu (50%); but Vocational rehab at VA stated the I'm currently not stable for school that why I put in the IU claim. I only have one job lasted for 6 months since 2006. I have a couple questions regarding the two claim i…
